FINDINGS, CONCLUSIONS, AND RECOMMENDATIONS

VICTIM NOTIFICATION REGARDING THE RELEASE OF SEXUALLY VIOLENT PERSONS

The Office of the Attorney General did not provide an "Information and Request for Notification of the Conditional Release or Discharge of a Sexually Violent Person" card to victims of committed sexually violent persons.

We tested 67 victims of individuals who were committed as sexually violent persons under the Sexually Violent Persons Commitment Act. Thirty-one of the 67 victims, constituting 46% of the sample, had not been provided the "Information and Request for Notification of the Conditional Release or Discharge of a Sexually Violent Person" card subsequent to the commitment of the offender as a sexually violent person. According to the Sexually Violent Persons Commitment Act, 725 ILCS 207/75, the Attorney General shall provide notification cards, without charge, to "the victim of the act of sexual violence, an adult member of the victim's family, if the victim died as a result of the act of sexual violence, or the victim's parent or legal guardian, if the victim is younger than 18 years old," if the court declares the offender to be sexually violent. (Finding 1, pages 13-14)

We recommended the Office coordinate efforts with the Illinois Department of Corrections and the Illinois Department of Human Services to receive a monthly update regarding the commitment of sexually violent persons. Upon the receipt of the update, we recommended the Office immediately provide the cards to the victims or their families.

The Office responded they interpreted the above referenced statute differently as it relates to the Office's responsibility to notify victims in Sexually Violent Persons cases. However, the Office stated it was implementing new procedures which were designed to provide a remedy to the audit finding and also ensure continued compliance with the Rights of Crime Victims and Witnesses Act by supporting the victim's right to (1) notification of court proceedings, (2) be informed about the conviction, sentence, imprisonment, and release of the accused, (3) be present at the trial and all other court proceedings on the same basis as the accused, and (4) have present at all court proceedings an advocate or other support person of the victim's choice.

AUDITORS’ OPINION

Our auditors stated the individual nonshared funds financial statements administered by the Office of the Attorney General for the year ended June 30, 2002 were fairly presented in all material respects.
